Encoding or Decoding of BIT STRING tag type parameter...

While encoding or decoding of a parameter which is of TAG type BIT STRING, is it necessary that the minimum number of bytes should be 4 in the ASN information if present as explained below..?
1st Byte              ? TAG value
2nd Byte              ? LENGTH value
3rd Byte              ? Number of UNUSED Bits
4th Byte onwards  ? VALUE (Data starts from here?)
So for example, if the ASN info for a parameter X which is of type BIT STRING is "0x86 0x01 0x00" only 3 bytes in which 0x86 is TAG value, 0x01 is LENGTH, 0x00 is Number of UNUSED Bits. (No data Here)
Is it right that encoding or decoding of this parameter should fail and drop the message and inform the sender with error..?
